DesignXR License by iTSikhwal Company
DesignXR is licensed, not sold. The software remains the exclusive property of iTSikhwal Company. The customer receives a limited, non-exclusive, non-transferable license to use the software.
Application comes with standard set of modules, 40 models. Customization, additional content, integrations, branding, or feature development are not included with the standard license and will be quoted separately.
Installation, technical support, on-site visits, maintenance, and training are chargeable unless specifically mentioned in writing.
VR headsets are not recommended for children below 10 years of age. Schools and guardians are responsible for ensuring safe usage.
Payment shall be made as per mutually agreed commercial terms. Failure to complete payment may result in suspension or cancellation of the license.
Support for issues arising due to Meta OS updates, firmware changes, operating system updates, third-party software, or platform updates is not included under the standard license.
All license fees and applicable GST are strictly non-refundable.
Meta Quest hardware warranty, servicing, repairs, replacements, or technical support are not included and must be obtained directly from Meta or an authorized service provider.
The Company does not guarantee uninterrupted or error-free operation of the software under all hardware, firmware, software, network, or environmental conditions.
The Company shall not be responsible for compatibility issues caused by third-party software, antivirus programs, operating systems, hardware, or network configurations.
Delivery timelines are estimates only and may vary due to technical, operational, logistics, or other unforeseen circumstances.
The Company shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages including but not limited to data loss, loss of profits, or business interruption.
In any event, the Company's total liability shall not exceed the total DesignXR License fee paid by the customer.
All software, graphics, educational content, documentation, trademarks, branding, and intellectual property remain the exclusive property of iTSikhwal Company.
Unauthorized copying, reverse engineering, redistribution, resale, modification, or reproduction is strictly prohibited.
The Company shall not be liable for delays or failure to perform due to events beyond its reasonable control including natural disasters, government actions, internet outages, pandemics, war, civil disturbances, or third-party service failures.
These Terms & Conditions shall be governed by the laws of India.
Any dispute arising from the DesignXR License shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India.
DesignXR and iTSikhwal Company shall not be liable for any reduction in device performance, increased usage of system resources (including but not limited to RAM, CPU, GPU, battery, or storage), or any software-related issues arising from the installation or use of the DesignXR application, except where required by applicable law. Users are responsible for ensuring that their device meets the minimum system requirements before using the application.
DesignXR and iTSikhwal Company shall not be responsible or liable for any personal injury, physical damage, property damage, or damage to VR headsets, controllers, mobile devices, computers, or any other equipment resulting from misuse, improper operation, failure to establish or maintain a safe play boundary, collisions with people or objects, or any other unsafe use of the application. Users are solely responsible for ensuring a safe and obstruction-free environment while using DesignXR.
Users acknowledge that VR/XR experiences require active movement and awareness of their surroundings. By using DesignXR, users accept all risks associated with the use of VR/XR technology and agree to follow all recommended safety guidelines provided by the device manufacturer and within the application.
By purchasing, activating, installing, or using DesignXR, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.
